Gerakan agrees definition of 'parent' should be clarified

Gerakan Youth agrees there should be clarity in the definition of "parent" under the law which resulted in unilateral conversion disputes.

The party's movement deputy head Andy Yong who held a watching brief in Indira Gandhi's appeal said of the three questions of law, the final one regarding the consent of both the father or mother was necessary when a child wanted to convert, was the most important.

"That question is of most concern that is the meaning of 'parent' due to the conflicting case law in the R Subashini case," he said.

Yong, who held a watching brief for Gerakan, said it was high time the judiciary clarified this issue once and for all.

"This is to set a precedent to explain cogently and clearly the meaning of it in order to achieve equality and justice conforming to the supreme law of the Federal Constitution," he said.

Yong said it would also be ideal if Parliament proposed to amend the relevant provision with regard to Article 12 (4) of the Federal Constitution once and for all.

He said perhaps the proposed Law Reform (Marriage and Divorce) Act 1976, as suggested by Minister in the Prime Minister's Department, Azalina Othman Said, should also look into this issue seriously and do the necessary amendment before tabling it in Parliament.

It is understood that the amendment to the Act could be tabled in this seating.
